TERMS & CONDITIONS

We/Us/Our/Company/Driver/Operator/Hummers & Harleys, indicates a reference to
our company (Triss Enterprises ABN 73676957351, trading as Hummers & Harleys),
The hirer/you/booking customer is the booking client
The booking customer is responsible in ensuring all passengers are aware of these conditions, and will be deemed responsible for the conduct
of all passengers in the vehicle at all times.The hirer is also responsible for any damage to exterior, interior and or contents of the vehicle
GENERAL HIRE
General hire, corporate functions, group events, school formals and debutant balls, Airport transfers etc
BOOKINGS & PAYMENTS
Whilst we appreciate you may need time to liaise with other proposed passengers, we receive many enquiries per day.
Therefore dates are only held for 24hrs from our sending enquiry reply.
We then hold a further 48 hrs from our sending a booking info request. After which, if we do not hear from you the date becomes
available again for other enquirers. Upon our sending the invoice, dates will once again be held for 48 hrs for payment to be received,
Dates are confirmed and booked upon receipt of deposit/payment only.
- All transactions are done in Australian Dollars All prices include GST
- A minimum booking of one hour applies to all bookings unless agreed otherwise by operators. Further minimum booking requirements may apply to some bookings and travel surcharges may also apply (to and from pick up)
- The hirer accepts that when deposit has been paid, that they have accepted all Terms & Conditions.
- Bookings with a hire date more than 7 days in advance – in order to confirm your booking. a $200 deposit is required.
You do not have a confirmed booking until deposit is received. - Please note that all deposits are non refundable.
- The full balance is due and payable 7 days prior to your event.
- Visa and MasterCard Credit card transactions attract 1.5 % surcharge (Amex and Diners not accepted)
- Bookings made within 7 days of hire date – full hiring fee is payable and non refundable upon cancellation
- We require credit card details for your booking which are held as security against waiting time, cancellation, no-show and vehicle damage etc. $1 is charged to the credit card and deducted from the final balance payment.
You will be notified of any pending additional charges
CANCELLATIONS
- Strictly no refunds of payments if cancelled within 7 days of hire date.
- No shows and last minute cancellations – full amount paid will be retained by operator
HIRE TIMES
- All one-hour bookings will allow for one pick-up point Each extra pick up will attract a $20.00 fee and must be advised at time of booking
- Extension of booking times on the day will be at driver’s discretion and also dependent on other booking requirements.
- Overtime rates are charged at $175 per 15 mins for extended hire beyond the time booked
- Excessive waiting time at pick up and any mid way drop off points (15 minutes and more) is NOT included in your price unless it has been specified. Any waiting time will be part of the agreed hire time or incur extra charges.
- Any other changes to the booking day may incur further charges.
WEDDING HIRE
BOOKINGS & PAYMENTS
- Date selected will be held for the enquirer for 3 days from our sending reply email after which if we do not hear from you the date becomes available for other enquirers,
Date selected will be held for a further 48 hrs from our sending the booking info request, after which, if we do not receive the info reply,
the date becomes available again for other enquirers.
Upon our sending the invoice, dates will once again be held for 48 hrs for payment to be received.
Dates are confirmed and booked upon receipt of deposit/payment only.
- All transactions are made in Australian Dollars

Saturdays/Sundays and all public holidays – minimum 2 hr charterTime is calculated from initial pick up to final destination drop off

A minimum 1hr hire is acceptable at other times however – not including photo shoots – any photo shoots will require a minimum 0f 1.5hrs
- Travel surcharges may also apply (to and from pick up)
- The hirer accepts that when deposit has been paid, that they have accepted all Terms & Conditions.

- Cancellations must be made in writing by letter or email
- Bookings made within 21 days (3 weeks) of hire date – full hiring fee is payable and is non refundable upon cancellation
- Bookings with a hire date more than 21 days (3 weeks) days in advance – a $500 deposit is required in order to confirm your booking. You do not have a confirmed booking until deposit is received. The full balance is due and payable 21 days
prior to your booked date. - If a full balance is not received by 21 days prior to the booked date the booking will be cancelled and the deposit forfeited.
- We may require credit card details for your booking which are held as security against waiting time, cancellation, no-show and vehicle damage etc. $1 is charged to the credit card and deducted from the final balance payment.

- Extension of booking times on the day must be authorized by Hummers & Harleys Admin and will be dependent on other booking requirements and also your driver’s suitability to extend
- Overtime rates are charged at $175 per 15 mins for extended hire beyond the time agreed upon
- Excessive waiting time at pick up and drop off points (15 minutes and more) is NOT included in your price unless it has been specified. Any waiting time will be charged at a rate of $175 per 15 minutes and charged to the credit card whose details are held or is to be paid direct to the Driver at end of travel in cash
- Any other changes to the booking day may incur further charges.
GENERAL CONDITIONS
- The driver is ultimately in total control of the hire and will communicate with the hirer regarding alterations to the hire or requests from the group
- The driver is responsible for the safety of the vehicle. Any passenger whose conduct is in breach of statutory regulations may be removed from the vehicle or prevented from boarding at the driver’s discretion.
- The person in charge of the hire (booking customer) will be responsible for the conduct of passengers and for any damage caused to the vehicle by passengers during the hire. Hummers & Harleys reserves the right to charge the hirer for all extra charges, cleaning and damage fees, fines and penalties
- Irresponsible behaviour that causes damage to the vehicle or endangers the safety of the other passengers will not be tolerated. This includes, but is not restricted to; sitting on the exterior of the vehicle, hanging out of the windows, shouting abuse, rudeness or intolerance with the driver, arguing with the driver, misuse of the equipment, fixtures or consumables in the vehicle and willful damage to the vehicle generally. Any such behavior on or off the vehicle at any time of the hire, the driver has the right to terminate the charter immediately and if necessary will call the police immediately
GENERAL CONDITIONS (cont)
- Opening of the emergency hatch in the roof is forbidden. This is used for emergencies only and hefty fines will apply if not adhered to. Such behaviour will or may, at the discretion of the driver, result in immediate termination cancellation of the hire of the hummer vehicle without compensation.
- The hirer accepts that the DVD and CD equipment is provided as a courtesy. In the event that the equipment fitted to the vehicle malfunctions prior to or during the hire, Hummers & Harleys accepts no liability whatsoever and no compensation shall be provided, nor will the company provide a refund
- The hirer holds the company, its agents or employees harmless of any liability for any personal or material damages arising from the conduct of his or her party.
- The company, its agents or employees shall not be held liable or responsible for any articles left in the vehicle and the hirer specifically indemnifies the company, its agents or employees from any such responsibility
YOUR RIDE
- While we make every effort to fulfill our commitment to you, we cannot assume responsibility for circumstances beyond our control, such as traffic, road and weather conditions, illness, vehicle breakdown etc
Hummers & Harleys will make every effort to provide similar replacement vehicle with afilliated/network companies however if not able
to do so will provide bus, car or alternate arrangements for transfers at it’s discretion. - Pick-up/drop-off needs to be arranged as close as possible to the desired specified location. However, due to the size of the vehicle some streets may be too small to navigate. These will need to be identified and arrangements made accordingly.
There may be instances where vehicles are unable to be negotiated over speed humps, through turns, driveways etc, or other instances rendering some locations inaccessible. In this case, we will endeavor to collect/deliver passengers at the closest possible point we can.
Should the driver deem any location or situation unsuitable for the vehicle, an alternative will be sought & used or termination of travel will occur if necessary – the driver’s decision will be final and no refund will be paid.
Drivers will stringently adhere to all legal road rules, at all times.
BREAK DOWNS
- Hummers & Harleys’ vehicles are always maintained to a high standard In the unlikely event of breakdown or in the event of a collision, we will do our best to provide a back-up vehicle or vehicles as quickly as possible. However, we cannot be held liable for any consequential loss incurred as a result of the breakdown or collision.
INSURANCES
- Our Insurance Policy covers all authorized persons travelling in the vehicle en route (going to) their hired destination. Passengers assume personal liability when entering and exiting our hummer vehicle. We reserve the right and demand full compensation and payment of any damage caused by the passengers or hiring parties or groups travelling in vehicles
ALCOHOL & OTHER
- Consumption of alcohol is strictly prohibited for persons under the age of 18 as by law in Australia. It is up to the hiring customer to ensure all passengers consuming alcohol are 18 years and over. The person booking the vehicle takes full responsibility that all alcohol brought into the vehicle for consumption whilst on route is done so by persons over 18 years of age.
Drivers reserve the right to check ID - The driver reserves the right to refuse to transport persons under the influence of intoxicating liquor or drugs, or who are, or are likely to become objectionable to other persons inside or outside the vehicle
- Red Wine is NOT permitted to be consumed in the vehicle at any time. Botttled straight spirits and shooter shots are not permitted
- If complimentary alcoholic drinks are offered with your booking – a maximum of 2 alcoholic drinks per person per day will be offered
- Alcohol provided by us is not allowed to be consumed outside of the vehicle
- It is against the law to smoke in a Public Transport Vehicle therefore NO SMOKING is allowed.
Further, smoking or the consumption or use of drugs or any contraband is not permitted in the vehicle at any time. This includes e-cigarttes and vapes
Failure to comply will result in the termination of hire without refund
DAMAGE SOLING AND LOSS
- The hirer will pay Hummers & Harleys for the costs of repairing any accidental or deliberate or malicious damage to the vehicle during
the hire period, plus reasonable administrative charges incurred in attending to the repairs - If there is damage to the vehicle which results in the vehicle being unavailable for future hire, then the hirer of the vehicle at the time the damage occurred will be held liable for losses resulting from lost or cancelled bookings, whilst the vehicle is repaired.
- If glasses are broken or lost, the hirer will be responsible for the cost of replacement (at $5 per glass).
- If equipment provided in the vehicle (including bar utensils, CD’s, DVD’s, LCD/TV’s, remote controls) is either lost or damaged, the hirer will be responsible for the cost of repair/replacement.
- Any repairs that are required will be correctly and appropriately quoted by a qualified repairer.
- Cleaning Fee: An additional cleaning fee will charged in the event of the hirer or any passenger soiling, staining or polluting the vehicle by vomiting, spillage of food or beverages or in any other way including inappropriate, vandalism or irrational behaviour will be charged at a flat rate of $450 (inc GST). (This includes carpet steam clean/washes down inside the vehicle./deoderiser)
In addition if the state of the vehicle results in the vehicle being unavailable for future hire, then the hirer of the vehicle at the time the damage occurred will be held liable for losses resulting from lost or cancelled bookings, whilst the vehicle is cleaned
PRIVACY POLICY
- All personal identifiable information collected is treated in the strictest confidence and will not be disclosed in full or in part to anyone other than Hummers & Harleys bookings and operations staff
